HOUSTON, TX — A father will spend half of 2014 behind bars for doing too much for his son.  After overpaying child support and seeing his son too often — breaking terms that were secretly modified without his knowledge — a judge sentenced him to a lengthy jail sentence.

Clifford Hall has been doing his best to give care to his 11-year-old son, who lives with his ex-wife.  He pays his child support and visits regularly.  “I’m his father it’s my responsibility to take care of him,” Hall said.

Last November, his child support payments were paid in full.  Sometime between then and now, the child support agreement between Hall and his wife was modified without his knowledge.  Hall wound up overpaying by $3,000, a fact that Harris County District Court Judge Lisa Millard found contemptible.

Another term that was modified without his knowledge was his visitation schedule.  Subsequently, Hall was found to have over-visited his son.

Judge Millard ended up finding Hall in contempt of court.

“When she said I remand you to the Harris County Jail for 180 days my mouth just dropped,” Hall told FOX 26 Houston.

In addition to the six month jail sentence, Judge Millard is forcing Hall to pay his ex-wife’s attorney fees.

“I can’t be there for my son in jail,” Hall said. “I can’t pay child support in jail. This is not in the best interest of the child.”

Hall is correct.  Such heavy-handed actions on the part of the court serve no one.  Not only is the child going to be deprived of his father for the next 6 months, but taxpayers will have to pay the father’s incarceration, and will potentially be forced to subsidize the mother’s living expenses in lieu of the child support payments.

It just goes to show us that no good deed goes unpunished in Police State USA.

  1. This is absurd. What actual LAWS did he break by caring for his son the way a father should? UNBELIEVABLE!!!!!!!!!!

  2. I’m a little confused by the disconnect between headline and actual story. In the video, it’s stated that he unintentionally underpaid his child support by $3,000, then caught up on payments once the error was discovered. Am I missing the part where someone (besides the author of the headline) references an overpayment? This is not to suggest that jail time – or an additional $3,000 in legal fees – is appropriate when someone is doing his best to care for his child. I’m just trying to separate the truth from the sensationalism.

    • (to the last comment…I was going to reply but had more to say :-) ) The news fellow at the beginning said he overpaid as well, but through the actual story I only heard him point out he’d caught up.
      This is totally ridiculous though when I know dead beat parents who owe years and years of payments, spend little to no time with there kids and are NOT sitting in jail! Seems a case to me where the EX has a special in and now he’s going to sit in jail…get behind…and get more jail time for no legit reason!!!

  4. He thought that his employer was underpaying his Child support payments so, he doubled them up. This lead to an overpayment. Apparently, overpayments are a violation of the support agreement. this is why he was found in contempt.

  6. This is an outrage! Im sitting here waiting on any payment of child support and this guy who is legitimately supporting his child goes to jail!! Put my dead beat of an ex in jail not this guy!

  7. How can you give your child too much support and visit them too much? I’m sure if dad had the ‘complexion connection’ and wanted to increase Junior’s allowance; pay for riding & ski lessons and give him a country club membership no one would bat an eyelash. Shame on it all. This judge needs to be removed from the bench….and have her ass whooped.

    I wish there was more we could do for this man because he has been disgustingly wronged by our system. To do everything in his power to support his son and avoid jail so he could remain free and continue to support him and then instead of applauding his efforts this is what he gets smh… Then to add insult to injury and have to pay his childs mothers attorney fees as well! Awful! Sad to think of how this jail time will not only stop him from supporting his son but you have to think his job will be affected, he will get behind in child support payments, get out have no means to make payments and get caught in the vicious cycle. Heartbreaking. Makes less than no sense to me. In addition to the petition I was also searching for some kind of gofund me account on his behalf that would allow people to make donations to assist him in maintaining his child support while he is wrongfully incarcerated. Couldn’t find anything but I was considering starting something. Any thoughts on wether that might be a good idea?

  11. I was confused when I read this article. I feel this man is doing what he is supposed to do and without being forced to do it. My ex- husband is in Texas and I’m in North Carolina we have twins together and he doesn’t see them (which is what he chooses to do)plus he is behind over $13,000 in child support. He should be doing time not this man.

  12. This is misuse of our judicial system and the Judge in this case should be disbarred and removed from the bench immediately! WHY didn’t didn’t the mother/exwife stand up and say something? This is absolutely ridiculous. How DARE the Judge think she has this much power! She will have to answer to a higher power for this failure of justice as well as failure as a human being.

He was “overpaying” to repay back child support he FAILED to pay!!!!! He now owes the wife lawyer fees because he failed to pay… the only part that “MIGHT” be true was the changes to the support agreement, and he was not notified, having worked with TX child support cases forever now… if that is the case it was because HE WAS AVOIDING NOTIFICATION…. again his own f’ing fault!!!! For a press like yours to continue to exploit and delude the truth is shameful. Get a conscious, morality, and ethics!
